Terms of Service

1. Who we are
Influx MENA - FZCO (“Influx”, “we”, “us”) is a Free Zone Company (FZCO) licensed by the Dubai Integrated Economic Zones Authority (IFZA), trade licence number 86452, with its registered office at IFZA Properties, Dubai Silicon Oasis, Dubai, United Arab Emirates. We operate a platform connecting brands (“Brands”) with user-generated content creators (“Creators”) for paid campaigns across the GCC. These Terms apply to anyone who creates an account, uses the platform, or otherwise interacts with our services (collectively, “Users”).
2. Accepting these terms
By signing up for an account or using Influx, you confirm that you are at least 18 years old, have legal capacity to enter a contract in your jurisdiction, and agree to be bound by these Terms, our Privacy Policy, and our Cookies Policy.
3. What Influx provides
- For Brands: tools to publish campaign briefs, receive matched Creator applications, shortlist Creators, commission content, and track delivery and payment.
- For Creators: tools to create a profile, receive campaign opportunities, submit content, and receive payment for approved submissions.
- Influx acts as a marketplace facilitator. Unless explicitly stated in writing, Influx is not the buyer of Creator services, the seller of Brand products, or a party to the underlying campaign agreement between a Brand and a Creator.
4. Account registration & security
- You must provide accurate, complete information at signup.
- You are responsible for maintaining the security of your account credentials and for all activity under your account.
- You must notify us immediately if you suspect unauthorised access to your account.
- Influx may require additional verification (trade licence, ID, work email) before enabling certain features.
5. Campaigns, briefs, and content
- Brands submit briefs that set the scope, budget, deliverables, and usage rights of a campaign. Creators apply or are matched; acceptance forms a separate agreement between the Brand and the Creator on the terms stated in the brief.
- Unless the brief states otherwise, copyright in submitted content remains with the Creator, with the usage rights specified in the brief licensed to the Brand upon approval and full payment.
- Creators warrant that content they submit is original, does not infringe any third party rights, complies with applicable advertising and disclosure rules (including any required #AD/paid-partnership tags), and does not include defamatory, illegal, or hateful material.
- Brands warrant that their brief and any supplied assets comply with applicable law and that they have the right to request the content described.
- Influx may remove content, suspend campaigns, or terminate accounts that we reasonably believe breach these Terms.
6. Payments & fees
- Campaign budgets are set in the Brand's preferred currency. Brands pay through the platform; Creators are paid out after content approval and brand payment.
- Influx charges a platform fee set in the current schedule, displayed in admin settings and on each campaign summary. The fee may be revised with notice to active Users.
- All amounts are exclusive of any applicable VAT or withholding taxes; Users are responsible for their own tax obligations.
- Refund and dispute processes will be documented in a separate Payments Policy to be adopted before launch.
7. Prohibited uses
You agree not to:
- Impersonate any person or misrepresent your identity, brand, or following.
- Circumvent the platform to make payment or receive payment for campaigns originated on Influx outside the platform.
- Scrape, copy, or mirror the platform, or use automated tools beyond our published rate limits.
- Upload malware, viruses, or unlawful content.
- Attempt to gain unauthorised access to other accounts or to the platform.
8. Intellectual property
The Influx name, logo, and platform software are the property of Influx. Users retain ownership of their User Content (profile information, submitted content), subject to the licences described in sections 5 and 11.
9. Suspension & termination
- You may close your account at any time from your settings.
- We may suspend or terminate accounts that breach these Terms, present a safety or legal risk, or are inactive for extended periods.
- Closed accounts are soft-deleted: personal data is removed or pseudonymised and financial records are retained as required by law.
10. Disclaimers & liability
To the fullest extent permitted by law, Influx provides the platform on an “as is” basis, without warranties of any kind. We do not guarantee specific campaign outcomes, Creator performance, or Brand payment reliability.
Our total aggregate liability to any User for all claims arising from these Terms or the platform is limited to the greater of (i) the total platform fees paid by or payable to that User in the six months preceding the claim, and (ii) AED 500. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Licence to Influx
You grant Influx a worldwide, non-exclusive, royalty-free licence to host, display, and distribute your User Content on the platform and in connection with marketing the platform (e.g. case studies), with attribution where reasonable. This licence ends when the content is removed from the platform, except for copies retained for legal or operational record.
12. Changes to these terms
We may update these Terms. If a change is material, we will notify active Users by email and in-app notice with reasonable advance notice. Continued use of the platform after the effective date constitutes acceptance.
13. Governing law & disputes
These Terms are governed by the laws of the United Arab Emirates, without reference to conflict-of-laws principles. Disputes will be resolved by the competent courts of [insert emirate / free zone] unless otherwise agreed in writing. Specific arbitration clauses will be inserted before launch subject to counsel's review.
